Terms of Service

These Terms of Service ("Terms") govern your use of Mind Games (the "App"), operated by Conner Coy (the "Developer," "we," or "us"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Mind Games. If you are under 18, you confirm that a parent or guardian is aware of and consents to your use of the App.

2. Your account

You are responsible for:

• Keeping your password confidential
• All activity that happens under your account
• Providing accurate information when you sign up
• Notifying us immediately at connerrcoy@gmail.com if you suspect unauthorized access to your account

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms or use the App in a way that harms other users, the service, or third parties.

3. What Mind Games is — and what it is not

Mind Games is a mental performance training tool for athletes. It provides visualizations, exercises, journaling prompts, daily check-ins, routines, and goal tracking.

Mind Games is not:

• Therapy, counseling, psychiatric care, or any other form of medical treatment
• A diagnostic tool for any mental health condition
• A substitute for advice from a licensed mental health professional or physician
• An emergency service

If you are in crisis, having thoughts of self-harm, or experiencing a mental health emergency, contact a licensed professional, call 988 (US Suicide & Crisis Lifeline), text HOME to 741741 (Crisis Text Line), or go to your nearest emergency room. The Mental Health Resources screen inside the App lists additional support options.

You agree not to rely on the App as a replacement for professional care.

4. Acceptable use

You agree not to:

• Use the App to harm yourself or others, or to encourage anyone else to do so
• Reverse-engineer, decompile, or attempt to extract source code from the App
• Use the App for any unlawful purpose
• Attempt to access another user's account or data
• Probe, scan, or test the security of our systems without permission
• Use bots, scrapers, or automated means to interact with the App

We reserve the right to suspend or terminate accounts that violate these rules.

5. Subscription ("Pro")

Some features of Mind Games are available only to Pro subscribers. Pro is sold through the App Store as an auto-renewing subscription.

• Payment is charged to your Apple ID account
• Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current period
• You can manage your subscription and turn off auto-renewal in your iOS Settings → Apple ID → Subscriptions
• Refunds are handled by Apple under the App Store's refund policy

We may change the price of a subscription. Any price change applies to the next billing period and you'll be notified before it takes effect.

6. User content

Your journal entries, check-ins, reflections, routines, goals, and other content you create in the App ("Your Content") remain yours. You grant us a limited license to store and display Your Content on your devices for the purpose of providing the App. We do not analyze Your Content for advertising, share it with third parties, or use it to train AI models.

You are responsible for Your Content. Do not include information that violates the rights of others or is illegal.

7. Intellectual property

The App, including its design, content (visualizations, prompts, exercises, stories), code, and trademarks, is owned by the Developer and protected by intellectual property law. You receive a personal, non-exclusive, non-transferable license to use the App for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the App or its content without written permission.

8. Notifications

If you enable notifications, the App will schedule reminders on your device at the time you specify. You can disable notifications at any time in the App's Profile screen or in your iOS settings.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or that it will produce any particular outcome (improved performance, reduced stress, etc.).

To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, the Developer is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of your use of the App.

Our total liability for any claim related to the App is limited to the greater of (a) the amount you paid to us in the twelve months before the claim, or (b) twenty US dollars.

Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will continue to apply.

12. Changes to these Terms

We may update these Terms over time. If we make material changes, we'll update the "Last updated" date above and notify you in the App. Continued use after the change means you accept the new Terms.

13. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in California, and you consent to the jurisdiction of those courts.

If you live in a jurisdiction whose laws give you mandatory rights that override this section, those rights apply.
